The Social Security Administration is responsible for providing Social Security benefits in each state. This includes Social Security disability benefits and Medicare, which you can receive while you are working. Social Security and New York
The federal government provides Social Security benefits to all eligible citizens in the United States. New York has Social Security offices in its cities and towns that are responsible to provide these Social Security benefits. It is the federal government and not the New York state government that decides individuals' eligibility to receive Social Security benefits, which includes Social Security disability benefits and Medicare.
SSD and Medicare
If you live in New York state and you are a Social Security disability recipient, you might be eligible to receive Medicare benefits, even if you are working. Medicare eligibility arises in two different situations: when you turn 65 years old or when you receive SSD benefits. If you are eligible to receive Medicare benefits based on your eligibility to receive SSD benefits, as long as you keep being eligible to receive SSD benefits, you are eligible to receive Medicare.
SSD and Work
The Social Security Administration pays Social Security disability benefits to people who are disabled or blind and who have paid Social Security tax. To be eligible to receive these benefits, you must have a medical condition that leads to death or that lasts more than 12 months. You can work while you receive SSD benefits, but you cannot earn more than the allowable limit. As of 2011, the allowable limit is $1,000 per month. If you earn more than this limit, the Social Security office does not consider you disabled, since you are producing substantial gainful activity. If you earn more than this limit, your benefits end.
Medicare Eligibility
You are eligible to receive Medicare in New York if you receive SSD benefits for two consecutive years or if you turn 65 years old. If you have received SSD benefits for two years, your Medicare benefits start on the month following your 24th month of SSD benefits. If your earnings become higher than the allowable limit, you lose your SSD benefits, and you eventually lose your Medicare benefits until you reach 65 years of age.
Medicare and Work
You can work up to eight years from the point at which you lost SSD benefits and continue receiving Medicare. After these eight years have passed, you also lose Medicare. If you still have some level of disability, you can purchase Medicare until you reach retirement age. Once you reach age 65, you are eligible to receive Medicare again for free.
